Section 8 — International Shipping; Delivery; Duties and Taxes
Alma Pure Ritual serves customers internationally.
We may ship to selected destinations across Europe, North America, South America, Asia, the Middle East, Africa, and Oceania, subject to product availability, logistical capabilities, legal restrictions, and the destinations available at checkout.
The countries and regions currently eligible for delivery are those made available during checkout.
Shipping methods, shipping charges, estimated delivery times, and any available shipping promotions are displayed at checkout and may vary depending on your destination, the products ordered, parcel weight, order value, and selected shipping method.
A complete and accurate shipping address, email address, and telephone number may be required to process and deliver your order.
We are not responsible for delays or failed deliveries caused by incorrect or incomplete information provided by the customer.

International orders may be subject to import duties, customs duties, VAT, GST, sales taxes, brokerage charges, or other fees imposed by the destination country or local authorities.
Unless expressly stated as included at checkout, such charges may be the responsibility of the customer, subject to applicable law.
Any mandatory consumer rights regarding delivery, transfer of ownership, or risk of loss under the laws applicable to the customer remain unaffected.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES AND ALL PRODUCTS AND SERVICES PROVIDED THROUGH THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” EXCEPT WHERE EXPRESSLY STATED BY US OR REQUIRED BY LAW.
NOTHING IN THESE TERMS EXCLUDES, RESTRICTS, OR MODIFIES ANY WARRANTY, GUARANTEE, CONSUMER RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED, RESTRICTED, OR MODIFIED UNDER APPLICABLE LAW.
Section 18 — Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ALMA PURE RITUAL, THEKEY LLC, AND THEIR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR REPLACEMENT COSTS, WHERE SUCH LIMITATION IS PERMITTED BY LAW.
18.1 Limitation of Direct Damages
To the maximum extent permitted by applicable law, the total aggregate liability of Alma Pure Ritual and THEKEY LLC arising out of or relating to these Terms, the Services, or any product shall not exceed the greater of:
(a) the total amount you paid to Alma Pure Ritual during the twelve (12) months preceding the event giving rise to the claim; or
(b) five hundred United States dollars (USD $500).
This limitation does not apply where prohibited by the laws applicable to the customer.
Nothing in this Section limits liability that cannot legally be excluded or limited under applicable consumer law.
Section 19 — Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless Alma Pure Ritual, THEKEY LLC, and their affiliates, officers, directors, representatives, contractors, licensors, service providers, suppliers, and employees from third-party claims and reasonable costs arising from:

your material violation of these Terms;

your unlawful or unauthorized misuse of our website or products; or

your violation of applicable law or third-party rights.
Nothing in this Section requires a consumer to indemnify us where such obligation would be prohibited or unenforceable under applicable law.
Section 20 — Time Limit for Claims
To the extent permitted by applicable law, any claim or cause of action arising out of or relating to these Terms, the website, Services, or a product must be initiated within one (1) year after the claim arose.
If applicable law does not permit such a contractual limitation period, the statutory limitation period applicable in your jurisdiction will apply.
Section 21 — Dispute Resolution; Binding Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT MAY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO BRING A CLAIM IN COURT.
THIS SECTION APPLIES ONLY TO THE EXTENT PERMITTED BY THE LAW APPLICABLE TO YOU. IT DOES NOT OVERRIDE MANDATORY CONSUMER RIGHTS OR DISPUTE-RESOLUTION RIGHTS AVAILABLE TO INTERNATIONAL CUSTOMERS UNDER THE LAWS OF THEIR COUNTRY OR REGION OF RESIDENCE.
21.1 Agreement to Arbitrate
To the extent permitted by applicable law, you and Alma Pure Ritual / THEKEY LLC agree that disputes, claims, controversies, or causes of action arising out of or relating to these Terms, the website, a product, advertising or marketing practices, or an alleged misrepresentation (“Dispute”) may be resolved through final and binding arbitration on an individual basis.
For transactions subject to United States law, the Federal Arbitration Act (9 U.S.C. § 1 et seq.) governs the interpretation and enforcement of this arbitration agreement where applicable.
This arbitration agreement does not eliminate consumer rights or remedies that cannot lawfully be waived.
21.2 Notice Before Arbitration
Before initiating arbitration, the initiating party must send written notice describing the Dispute and including:

The parties will attempt in good faith to resolve the Dispute informally for thirty (30) days before arbitration is initiated.
21.3 Arbitration Procedure
Where applicable, arbitration will be administered by the American Arbitration Association (“AAA”) under its applicable Consumer Arbitration Rules before a neutral arbitrator, unless the parties agree otherwise or applicable law requires another procedure.
If the AAA is unable or unwilling to administer the arbitration, the parties may agree on another recognized arbitration provider or, where permitted, a court of competent jurisdiction may appoint an arbitrator or provider.
The arbitrator may award any individual remedy available under applicable substantive law.
Fees will be allocated in accordance with applicable arbitration rules and law.
21.4 Right to Opt Out
Where this arbitration provision applies, you may opt out within thirty (30) days after first accepting these Terms by sending written notice to:

Your notice must include your name, address, email address, and a clear statement that you wish to opt out of the arbitration agreement.
Opting out does not affect your other rights or obligations under these Terms.
21.5 Small Claims and Injunctive Relief
Either party may bring an individual claim in a court legally authorized to hear small claims where the requirements for doing so are met.
Nothing in this Section prevents Alma Pure Ritual / THEKEY LLC from seeking lawful injunctive relief relating to intellectual property, confidential information, unauthorized resale, fraud, or abuse of the website where legally permitted.
21.6 International Consumers
If you reside outside the United States and mandatory laws applicable in your country or region provide you with rights to bring disputes before local courts, consumer authorities, alternative dispute-resolution bodies, or other legally designated forums, nothing in this Section is intended to deprive you of those mandatory rights.
21.7 Claim-Specific Severability
Where applicable law prohibits arbitration or waiver of a particular claim or remedy, that claim or remedy may be pursued before a court or authority with appropriate jurisdiction.
All remaining arbitrable claims remain subject to arbitration to the extent legally permitted.
Section 22 — Class Action Waiver
TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND ALMA PURE RITUAL / THEKEY LLC AGREE THAT DISPUTES SUBJECT TO ARBITRATION WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS.
Where legally permitted, you waive the right to participate in or act as a representative in a class, collective, consolidated, or representative proceeding.
This waiver does not apply where applicable law prohibits such a waiver or grants you mandatory collective or representative rights.
Section 23 — Mass Action Waiver
To the extent permitted by applicable law, disputes subject to arbitration may not be submitted or administered as coordinated mass arbitration without the consent of Alma Pure Ritual / THEKEY LLC.
This provision does not apply where mandatory applicable law provides otherwise.
Section 24 — Jury Trial Waiver
Where a Dispute proceeds in court and waiver of a jury trial is legally permitted, you and Alma Pure Ritual / THEKEY LLC waive the right to a jury trial to the maximum extent permitted by applicable law.
This provision does not apply where such a waiver is prohibited or unenforceable.
Section 25 — Governing Law and International Consumer Rights
Except as otherwise provided regarding the Federal Arbitration Act, these Terms and any separate agreements through which we provide Services are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict-of-law principles.
Subject to the arbitration provisions above, disputes not subject to arbitration may be brought before a court of competent jurisdiction in the State of Wyoming, except where mandatory applicable law grants a consumer the right to bring proceedings in another jurisdiction.
If you are a consumer residing outside the United States, nothing in these Terms deprives you of mandatory consumer protections provided by the laws of your country, state, province, territory, or habitual place of residence that cannot lawfully be waived by contract.
Where applicable consumer law provides protections that conflict with these Terms, those mandatory protections will prevail to the extent required by law.
Section 26 — Intellectual Property
All website content, including text, photographs, graphics, illustrations, trademarks, trade names, logos, videos, software, product designs, and design elements, is owned by or licensed to Alma Pure Ritual and/or THEKEY LLC and is protected by applicable United States and international intellectual property laws.
These Terms permit you to use our Services solely for personal, non-commercial purposes.
You may not reproduce, distribute, modify, commercially exploit, or create derivative works from our website content without our prior written consent except where permitted by applicable law.
All rights not expressly granted are reserved.
Section 27 — Assignment
You may not transfer or assign these Terms or your rights or obligations under them without our prior written consent where such restriction is permitted by applicable law.
Alma Pure Ritual, THEKEY LLC, and their affiliates may transfer or assign these Terms and related rights and obligations to the extent permitted by applicable law, including in connection with a merger, acquisition, restructuring, sale of assets, or operation of law.
Nothing in this Section limits mandatory consumer rights.
Section 28 — No Waiver
Our failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of that right or provision or our right to enforce it in the future.
A waiver is effective only where properly authorized and, where required, made in writing.
Section 29 — Severability
If any provision of these Terms is determined to be unlawful, void, invalid, or unenforceable, that provision will remain enforceable to the maximum extent permitted by applicable law.
Any unenforceable portion will be treated as severed from these Terms.
The validity and enforceability of the remaining provisions will not be affected.
Section 30 — Termination
These Terms remain effective while you use our Services or while obligations arising from a contract between you and us remain outstanding.
If you materially violate these Terms, we may restrict or terminate your access to the Services to the extent permitted by applicable law.
You remain responsible for all amounts lawfully due before termination.
Provisions relating to intellectual property, warranty disclaimers, limitations of liability, indemnification, dispute resolution, governing law, and payment obligations will survive termination to the extent applicable.
Section 31 — Entire Agreement
These Terms, together with our Privacy Policy, Return & Refund Policy, and any other policies expressly incorporated by reference, constitute the agreement between you and Alma Pure Ritual / THEKEY LLC regarding the Services to the extent permitted by applicable law.
They supersede previous agreements or communications relating to the same subject matter where legally permitted.
Any ambiguity in these Terms will be interpreted in accordance with applicable law.
